"TO KEEP YOUR LIFE ON TRACK"

MOOSBRUGGER LAW OFFICE is dedicated to providing top quality legal representation to people facing prosecution in court based on the principle that our laws are meant to improve people’s lives, not hinder them.

“We hold these truths to be self evident: that all men are created equal and endowed by their creator with certain inalienable rights.” ~ Declaration of Independence ~

I will personally represent you in your case. I spend time with my clients to ensure that they are comfortable and understand their rights and options so that they can make informed decisions.

Most clients choose to resolve the case without a trial. This may be done by a motion for dismissal where police have failed to follow proper procedures. Or the case may be resolved by a plea bargain, if the client decides the plea bargain is in their best interest and agrees with it. The decision whether to have a trial is always made by the client after we fully examine all options. As the following cases show, the prosecutors know very well that if they do not make an offer my client finds acceptable, I will take them to trial.

I have represented many hundreds of clients, from professionals and business owners to corrections officials and people from all walks of life. I am proud of the work I do for my clients. Listen to these testimonies about a few of the many cases I have personally successfully defended:

• Her husband was arrested for selling drugs. The police informant claimed she was involved in the drug deal, and she too was arrested. She was facing jail, and she was more concerned for her daughter and grand child than she was for herself. If she went to jail, there would be no one to help care for her family. She knew she was innocent, but no one seemed to believe her. I took her case and filed a motion to prove in court that there was no solid evidence against her. The judge agreed and all charges were dismissed without even having to go to trial.

• He was at a party when two guys started to rough him up. He fought back, and one of them ended up with a broken jaw. The prosecutor charged him with Assault. He was young and had his whole future ahead of him. He could not afford an assault conviction on his record. I took the case to trial and raised Self Defense. Once the jury heard the full story, they found him innocent.

• An acquaintance of our client accused him of breaking into her house and forcing sex on her while she was sleeping. The next thing he knew, he was arrested for Felony Burglary and Criminal Sexual Conduct and was looking at several years in prison if convicted. The case involved DNA evidence, finger prints, and other forensic evidence. He felt overwhelmed and frightened. He and some friends had socialized with her at her home earlier that evening, and when they left everything was fine. It was a hard-fought trial, but in the end the jury found my client innocent on all charges. Case closed.

• This client came to me when he was arrested for allegedly shooting a man in the abdomen. It was a case of Mistaken Identity. After my cross examination of prosecutor’s star witness, case was Dismissed. Client Cleared of all Charges.

• After receiving a Domestic Assault ticket, this new client heard about me through another one of my clients. An Assault on his record could mean the end of his job. The prosecutor offered a good deal, but my client did not feel it was right that he should have to plead guilty to something he did not do – no matter how good the deal was. At trial, jury found my client Not Guilty.

• Police found stolen property in his possession. Even though he explained that he did not know it was stolen, they brought charges for Felony Possession of Stolen Property. Client decided he would fight the case all the way to jury trial. Jury found my client Not Guilty.

• Client’s girl friend claimed he threatened her with a gun: Felony Assault & Terroristic Threats. The prosecutor focused on my client’s prior record and demanded prison time. We took it to trial. Jury said Not Guilty both counts.

• She got pulled over in her car with Stolen License Tabs on it. She explained that she had given her former boyfriend money to buy her some new tabs, but he had spent the money and then put some stolen tabs on her car without telling her. The police and the prosecutor weren’t listening. But the jury was. After a short trial and deliberation, they returned a Not Guilty verdict.

• Police searched his car and found drugs. He was charged with Felony Controlled Substance Crime. I brought a motion challenging the legality of the search on the basis that the officers conducted the search in violation of constitutional restrictions. The judge ruled on our favor, and the charge was dismissed without the necessity of a trial.

• Police pulled him over for “illegal lights” on his pick-up. Police smelled alcohol and ended up writing a ticket for DWI. I brought a motion in court to challenge the legality of the stop on constitutional grounds. Motion granted – case dismissed.
